Do Australian WHS laws require a daily pre-start for construction plant?

Not as a general rule. The model WHS Regulations, which Safe Work Australia says every jurisdiction except Victoria has implemented (some with variations), contain no daily pre-start requirement. Regulation 213 requires plant to be maintained, inspected and, if necessary, tested by a competent person, following the manufacturer's recommendations, or a competent person's where there are none, and inspected annually if neither is reasonably practicable. Regulation 225 is stricter for scaffolds, including any from which a person or thing could fall more than 4 metres: written confirmation from a competent person before first use, then an inspection at least every 30 days. Your principal contractor may still require daily pre-starts.

How do I make a construction checklist?

Start from the machine or the task, not a blank page. List the items in the order someone walks through them, give each a pass, fail or not applicable result, and add the site, date, the person checking and a sign-off. Leave room for defects and the action taken, and make it clear the plant or area is not used until a failed item is fixed.
