  2. Agree the commercial terms before dispatch: Fix the rate basis, the minimum hire period, what happens during site shutdowns and how off-hire notice is given. These are the four things that generate most invoice disputes, and all four are easy to settle in advance.
  3. Record the handover condition and attach the evidence: Complete a condition record on the same day, with the meter reading, fuel level and photographs of every existing mark. The damage clause is only as good as the baseline it is measured against.
  4. Confirm insurance and operator requirements: Check the hirer holds the cover the agreement requires and that anyone operating the item is competent and licensed where a licence applies. Confirming this before dispatch is far cheaper than discovering the gap after an incident.
  5. Sign, exchange copies and register the hire: Both authorised signatories sign and date the agreement, each party keeps a copy, and the hire is entered against the asset record with the due-back date so the item does not disappear into a long hire nobody is tracking.
  6. Off-hire against the same document: On return, inspect against the handover condition record line by line, agree any damage and its rectification, record the final meter reading, and close the hire so charging stops on the date both parties agree.

How often should you complete this form?

Put an agreement in place before every hire, including short ones and repeat customers. The hires that go wrong are almost always the informal ones, because familiarity is exactly the reason nobody wrote anything down.

For customers who hire regularly, a master agreement covering the standing terms plus a short schedule per hire is far less friction than a full contract each time. Review the master terms at least annually, and any time your insurance requirements, rate structure or the law affecting unfair contract terms changes.

Rental is the more common term in the United States and hire is the more common term in Australia, the United Kingdom and much of Asia, but both describe the same arrangement: the owner keeps title and the customer gets possession and use for a period in exchange for payment. What matters is not the label on the document but whether it covers the period, the rate, the condition baseline, the damage liability and the return process.

That is what the agreement has to decide, and it should be explicit. The common arrangement is that the hirer carries the risk of damage, loss and theft while the item is in their possession, with fair wear and tear excluded, and holds insurance to an agreed level with a stated excess. Fair wear and tear is the phrase that causes trouble, so define it: it usually means deterioration from normal use, not damage from misuse, overloading, wrong fuel or lack of daily servicing.
